These Terms of Service and Website Use (“Agreement”) govern (a) all cleaning services provided by Wiz Cleaners LLC (“Wiz Cleaners,” “Company,” “we,” or “us”), and (b) your use of the website www.wizcleaners.com (the “Site”). By booking, scheduling, or receiving services, or by accessing or using the Site, you (“Customer,” “User,” or “you”) agree to be bound by this Agreement and our Privacy Policy available at www.wizcleaners.com.
By booking or using our services, whether online, by phone, by text, by email, or through any third-party platform, you confirm that you have read, understood, and agree to these Terms. This Agreement constitutes a legally binding agreement governing each service engagement. It does not create a long-term commitment or require ongoing service beyond what you have scheduled. You represent that you are at least 18 years of age and have the legal authority to authorize services at the property identified in your booking. If you do not agree, do not use our services or this Site.
PART A: CLEANING SERVICES TERMS
1. SERVICES
Wiz Cleaners provides residential and commercial cleaning services performed by trained employees or authorized personnel. Services are based on:
– The scope selected at the time of booking
– The condition of the property as represented by the Customer
All services are performed in accordance with the agreed scope outlined at booking. If any changes or additional requests arise, they must be approved by the Wiz Cleaners office prior to or during the service.
For quality, safety, and consistency, technicians are not authorized to modify the scope of work on-site. Any updates must be coordinated through the office to ensure proper scheduling, pricing, and service standards.
Wiz Cleaners is not responsible for tasks outside of the originally agreed scope. Additional services will only be performed and charged once approved by the office.
Customers agree not to interfere with or direct technicians during service in a manner that disrupts workflow, efficiency, or service quality. Any changes to the scope of work must be communicated and approved through the Wiz Cleaners office.
2. SCHEDULING AND ARRIVAL WINDOWS
Services are scheduled Monday through Friday. Weekend appointments may be available at the sole discretion of Wiz Cleaners and are not guaranteed. We operate within a 45-minute arrival window. For example, a service scheduled at 11:00 AM may arrive between 10:15 AM and 11:45 AM. While we aim for consistency, the same technician is not guaranteed for each visit. Scheduling is subject to availability and may be affected by circumstances beyond our control, including force majeure events described in Section 23.
3. ACCESS TO PROPERTY
Customers are responsible for providing safe and timely access. Accepted methods include:
– Being present
– Lockbox or key
– Concierge or front desk
– Entry codes or alarm instructions
Customers are responsible for ensuring access instructions are accurate and current. Wiz Cleaners is not responsible for any issues caused by incorrect, incomplete, or outdated access details. If access is not provided when our technician arrives, or if service is declined upon arrival, a 50% lockout fee will apply.
The Customer must ensure that running water and electricity are available at the time of service. Wiz Cleaners reserves the right to refuse or stop service if required utilities are unavailable, and applicable fees may apply. Delays in access, incomplete instructions, restricted entry, or unavailable utilities may impact the service and overall results. Wiz Cleaners reserves the right to prioritize areas based on the agreed scope and property condition. We are not responsible for any areas that cannot be completed due to these limitations.
4. PAYMENT TERMS
A valid credit or debit card is required on file to confirm all bookings. Payments are processed via credit or debit card only. Wiz Cleaners does not accept checks or cash. Payment is processed on the day of service.
You expressly authorize Wiz Cleaners to charge your card on file for:
– Scheduled services
– Cancellation or lockout fees
– Additional approved services
– Parking charges
– Outstanding balances
– Any other amounts due under this Agreement
Declined payments may result in service interruption, additional processing fees, or account suspension. Any outstanding balance is subject to collection, and you agree to reimburse Wiz Cleaners for all reasonable costs of collection, including attorneys’ fees.
Initiating a credit card payment reversal for services rendered, without first contacting Wiz Cleaners and allowing reasonable time to resolve the concern, constitutes a breach of this Agreement. In such cases, Wiz Cleaners reserves the right to pursue the full disputed amount plus an administrative processing fee, suspend all services, and refer the matter to collections.
5. CANCELLATION AND RESCHEDULING
A minimum of 24 business hours’ notice is required to cancel or reschedule a service without penalty. Business hours are defined as Monday through Friday, before 5:00 PM. Requests submitted after 5:00 PM on Friday or at any time during the weekend will be considered received on the next business day and do not satisfy the 24-hour notice requirement.
Cancellations or rescheduling requests made with less than 24 business hours’ notice will be subject to a 50% cancellation fee based on the scheduled service total. This policy applies to all cancellations, including those due to personal circumstances, illness, or schedule changes.
If a client or occupant is experiencing a contagious illness, we ask that you notify us as soon as possible. For the safety of our team, Wiz Cleaners reserves the right to reschedule the service. Standard cancellation and rescheduling policies will still apply.
This policy also applies to the permanent cancellation of recurring services. Recurring services will continue as scheduled unless properly canceled in accordance with this policy.
Customers may cancel or reschedule services by contacting our office directly via phone call or text message at (305) 874-0260. These are the only accepted methods for cancellation or rescheduling requests. Requests submitted through email, social media, or any other communication platform are not considered valid forms of cancellation or rescheduling. Direct communication with technicians is also not an accepted method.
Failure to use the approved communication methods will result in the request being considered invalid, and the applicable cancellation or rescheduling fee will be charged.
6. RECURRING SERVICES
Recurring services are scheduled automatically based on your selected frequency. Skipping or rescheduling requires at least 24 business hours’ notice. If a cleaning is skipped, a skip adjustment fee may apply on the next visit. If more than one (1) skip occurs within a three (3) month period, pricing may be adjusted going forward.
Interruptions in recurring frequency may require additional work and charges to restore the property to a maintenance level. Pricing is based on maintaining consistent service frequency and condition.
All prices provided prior to service are estimates based on the information given at booking, including property size, condition, and scope of work. PRICES ARE ESTIMATES ONLY AND ARE NOT GUARANTEED.
Upon arrival, the cleaning team will assess the actual condition and scope of the property. If conditions differ from what was represented at booking, including heavier buildup, additional areas, different property details, or occupied versus vacant conditions, adjustments to the scope and price may be required. Final pricing may increase by 25% or more based on these factors.
Any such adjustments must receive prior customer approval before proceeding. Approval may be obtained verbally, via text message, email, or in writing from the customer or an authorized representative on file.
If approval for adjustments is not obtained, areas outside the originally approved scope may be excluded. Additionally, if the condition of the property differs from what was represented at booking or requires a higher level of detail or effort, certain areas within the general scope may be deferred in order to prioritize primary service areas. In such cases, the service may be left partially incomplete.
Heavily soiled or high-buildup areas may require additional services and may not be fully completed during the initial visit. Multiple services may be required to achieve desired results.
Customers who knowingly misrepresent property size, condition, or scope at the time of booking in order to obtain a lower price assume full liability for any resulting pricing adjustment. Wiz Cleaners reserves the right to refuse service or proceed at a revised rate upon arrival without penalty to the Company. If the Customer declines the adjusted scope or pricing after the team has arrived, a 50% service fee based on the original scheduled service total will apply.
Services are performed based on the agreed scope, property size, and condition. The level of detail required in certain areas may vary depending on buildup, layout, and accessibility. As a result, some areas may require more attention than others, and certain tasks may be prioritized to ensure the overall service meets quality standards within the scope provided. Wiz Cleaners does not guarantee that all areas will be completed if conditions require additional attention in prioritized areas.
8. INITIAL CLEANING EXPECTATIONS
First-time or deep cleanings may require additional time to reach a maintenance level. In some cases, excessive buildup may not be fully removable in a single visit and may require multiple cleanings. Ongoing services improve consistency and overall results over time.
Certain conditions, including heavy buildup, staining, or long-term neglect, may not be fully resolved in a single visit. Multiple services may be required to achieve desired results, and Wiz Cleaners does not guarantee full restoration of affected areas.
8.1 Client Presence for Initial Cleaning
For the initial cleaning service, the Customer is strongly encouraged to be present on-site to communicate expectations, provide real-time feedback, and confirm satisfaction with the results. Being present at the initial visit significantly reduces the likelihood of misaligned expectations and missed areas.
If the Customer is not present during the initial cleaning, the Customer assumes full responsibility for reviewing the completed service within the 24-hour window outlined in Section 17. Wiz Cleaners is not liable for any concerns raised outside of this window, regardless of whether the Customer was present at the time of service.
9. CUSTOMER PREPARATION
To ensure efficient service, customers should provide clear access instructions, ensure all requested areas are accessible, minimize clutter, clear sinks unless dish service was requested, and secure pets. If areas are not accessible, cleaning will be performed around items, which may impact results.
Excessive clutter may limit access to surfaces and areas. In such cases, cleaning will be performed around items, which may impact the overall result. Wiz Cleaners is not responsible for areas that cannot be reasonably accessed due to clutter or obstructions.
Cleaning is a maintenance service, not a restoration service. Wiz Cleaners is committed to delivering professional, high-quality cleaning services in accordance with the agreed scope and our service standards.
However, Wiz Cleaners makes no warranties, express or implied, including any implied warranties of fitness for a particular purpose or merchantability. All services are provided on an “as-is” basis, based on the condition of the property at the time of service.
Customers acknowledge that:
– Dust resettlement is normal after cleaning
– Hair and dust may return quickly, especially in pet households
– HVAC filter changes every 2 to 3 months are recommended to reduce dust
– Hard water, calcium, lime, and rust deposits may not be fully removable
– Some stains, discoloration, or wear may be permanent
– Results vary based on property condition
Due to variations in property condition, materials, and buildup, certain results may not be achievable. Wiz Cleaners does not guarantee the removal of permanent stains, discoloration, damage, or conditions that require restoration, repair, or specialized treatment beyond standard cleaning.
Wiz Cleaners does not guarantee the removal of odors, including but not limited to pet odors, smoke, mildew, or other embedded smells, as such conditions may be permanent or require specialized treatment beyond standard cleaning.
Results are based on a best-effort basis within the scope of service. While we strive to deliver high-quality results, certain conditions may limit the effectiveness of standard cleaning methods.
11. CUSTOMER-PROVIDED PRODUCTS AND EQUIPMENT
Wiz Cleaners provides all necessary cleaning products and equipment. If a customer elects to provide their own, the office must be notified in advance and product usage instructions must be documented in the work order. Wiz Cleaners is not responsible for any damage, adverse reactions, or unsatisfactory results from customer-provided products. The Customer assumes all associated risks and agrees to indemnify Wiz Cleaners from any resulting claims. Wiz Cleaners may decline to use any product that poses a safety risk.
12. PARKING POLICY
Parking is not included in service pricing. If free parking is unavailable, the Customer may pay directly, or Wiz Cleaners will pay and charge the card on file. A 4% processing fee applies to parking paid by Wiz Cleaners.
Customers are responsible for providing accurate and complete parking and access instructions prior to the service date. Wiz Cleaners is not responsible for fines, citations, towing charges, tickets, or any related costs resulting from incomplete, incorrect, or undisclosed parking or access instructions provided by the Customer. Any such costs incurred by Wiz Cleaners during the performance of the service may be charged to the card on file.
Parking limitations, restricted access, or building requirements may impact the service and overall results. Wiz Cleaners reserves the right to prioritize areas based on the agreed scope and property condition and is not responsible for any areas that cannot be completed due to these limitations. If these conditions require additional work or result in changes to the service scope, adjustments to pricing may be necessary and will be communicated for approval prior to proceeding.
13. SERVICE LIMITATIONS
Wiz Cleaners does not perform the following services, without limitation:
– Restoration services (floors, grout, heavy buildup)
– Mold, biohazard, or hazardous material cleaning (blood, bodily fluids, infestations, rodent contamination)
– Carpet deep cleaning or extraction
– Moving heavy furniture or appliances
– Cleaning electronics or sensitive equipment
– Cleaning collectibles, delicate decor, religious items, or irreplaceable pieces
– Cleaning inside hutches, curio cabinets, or enclosed display furniture
– Cleaning walls, cabinet tops, or high inaccessible areas
– Cleaning chandeliers or fragile light fixtures
– Handling pet waste, cat litter, or diaper disposal systems
– Multi-story or difficult-to-access exterior window cleaning
– Deep floor restoration, scrubbing, or steam cleaning
– Cleaning inside stove coil plates or internal air vent systems
We do not climb higher than a 2-step ladder. Higher areas are dusted with extension tools only. We cannot guarantee results for mini-blinds, heavy buildup, or permanent stains.
Wiz Cleaners does not handle biohazard conditions, including but not limited to human or animal waste, urine, feces, blood, bodily fluids, pest infestations, or any hazardous or unsanitary environments. If such conditions are present, Wiz Cleaners reserves the right to refuse or stop service, and applicable fees may apply.
Laundry Services Disclaimer
If laundry services are requested, Wiz Cleaners is not liable for any damage to clothing or items when using customer-provided machines. We are not responsible for pre-existing defects, tears, fabric deterioration, color fading, shrinkage, or damage to delicate garments. Customers must provide laundry instructions and check all pockets. Wiz Cleaners does not inspect pockets and is not responsible for damage caused by items left in clothing. We are not responsible for loose or detachable items including jewelry, watches, cash, buttons, zippers, or similar items.
Glass, Blinds, and Surface Waiver
Wiz Cleaners is not liable for scratches on tempered or plate glass, or for damage to blinds. Some glass surfaces may have pre-existing imperfections not visible prior to cleaning; standard cleaning may reveal these. If a customer requests the use of specific tools such as scrapers, the customer assumes all associated risks. Wiz Cleaners is not responsible for mechanical failure of blinds or damage to brittle, aged, or poorly maintained materials.
14. CONSTRUCTION DISCLAIMER
Wiz Cleaners is not responsible for cleaning results where construction or contractor work is ongoing or has recently occurred. Post-construction and post-renovation cleaning are distinct service types with separate pricing and scope.
If the property is represented as clean or maintenance-level at booking but construction-related conditions are present upon arrival, including paint splatter, drywall or white dust, fine particulate buildup, debris, or residue, this will be considered a material difference in condition.
In such cases, Wiz Cleaners reserves the right to adjust the scope and price, subject to prior customer approval, perform cleaning within the originally agreed scope only, or decline the service.
If service is declined, or if these conditions prevent the team from performing the originally scheduled service type, a fee of 50% of the scheduled cleaning cost will be charged to the card on file.
Services performed in environments with active or recent construction, whether disclosed or not, do not qualify for re-cleans, touch-ups, or satisfaction-based service requests related to construction dust, debris, or residue.
15. SAFETY AND RIGHT TO REFUSE SERVICE
Wiz Cleaners reserves the right to refuse or stop service at any time if conditions are deemed unsafe, including but not limited to hazardous materials, pest infestations, excessive clutter or hoarding, aggressive animals, or illegal activity. Wiz Cleaners also reserves the right to refuse or stop service if interior temperature conditions are unreasonably hot or cold and pose a health or safety risk to technicians. A 50% fee may apply if service is refused or stopped after arrival.
16. RESPECTFUL WORK ENVIRONMENT
Customers must provide a safe, respectful, and non-hostile environment. Harassment, discrimination, or unsafe behavior may result in immediate service termination, permanent refusal of future services, and applicable fees still being charged.
17. SATISFACTION GUARANTEE AND REFUND POLICY
Concerns must be reported within 24 hours of service. We will re-clean affected areas at no additional cost. Re-cleans must be scheduled and completed within 3 business days of the original service date. Requests outside this window will not be honored, as the condition of the property cannot be verified beyond this timeframe. Re-cleans are limited to specific reported problem areas and do not qualify for full refunds. A re-clean will not be provided if the issue is inconsistent with the ordered scope, or if the customer failed to provide adequate preparation or access. Each service visit is eligible for one re-clean request only. Re-clean requests may not be expanded to new or additional areas beyond those reported at the time of the original complaint. ALL SERVICES ARE OTHERWISE NON-REFUNDABLE.
If no notice of a concern is received within 24 hours of service completion, the service will be deemed accepted and satisfactorily completed in full. This deemed acceptance is binding and waives any right to request a re-clean, dispute the charge, or assert a quality-related claim for that service visit.
18. VALUABLES, DAMAGE, AND LIABILITY
Customers are responsible for securing valuables and fragile items prior to service. Wiz Cleaners is not responsible for pre-existing damage, normal wear and tear, or damage to improperly secured or unstable items.
If damage occurs: (a) claims must be reported within 24 hours; (b) photos and a written description must be provided; (c) the item must be retained for inspection. Upon review, if Wiz Cleaners determines a valid claim exists, the Company will initiate a claim through its insurance provider where applicable. Resolution will be handled in accordance with the insurance process and the terms of the applicable policy. Failure to report damages promptly may result in denial of the claim by the insurance carrier and waiver of any right to compensation. Wiz Cleaners’ maximum liability is $100.00 per item where value is verifiable with documentation. Wiz Cleaners may elect to repair rather than replace. This limitation applies regardless of the cause.
19. EMPLOYEE NON-SOLICITATION
Customers agree not to directly hire, solicit, or engage Wiz Cleaners employees during their employment or within 12 months following termination. Violation results in a $3,500.00 referral fee charged to the payment method on file, representing a reasonable estimate of recruitment and training costs.
20. PHOTOS, VIDEO, AND DOCUMENTATION
Wiz Cleaners may photograph or record before, during, and after service for quality control, documentation, and marketing. We take reasonable steps to avoid capturing personal or identifying information. By using our services, you grant Wiz Cleaners a non-exclusive, royalty-free license to use non-identifiable images for marketing purposes including social media and website content.
To opt out of marketing use, you must notify us in writing via text message to (305) 874-0260 before your scheduled service date. Opt-out requests received after the service may not apply to content already captured or published.
20A. REVIEWS AND PUBLIC STATEMENTS
Customers agree not to post false, misleading, or defamatory statements about Wiz Cleaners, its employees, or its services on any public platform, including but not limited to Google, Yelp, Facebook, or any social media channel. Reviews and public statements must be based on the Customer’s direct, firsthand experience with the specific service received.
Wiz Cleaners reserves the right to respond publicly to reviews and to pursue all available legal remedies for knowingly false or defamatory statements that cause reputational or financial harm to the Company, its employees, or its business operations.
21. SMS AND TEXT MESSAGE CONSENT (TCPA)
By providing your mobile phone number to Wiz Cleaners, whether through booking, inquiry, or account registration, you expressly consent to receive automated and manually dialed text messages (SMS/MMS) from Wiz Cleaners, including:
– Booking confirmations and appointment reminders
– Service updates and technician arrival notifications
– Rescheduling and cancellation communications
– Promotional offers, seasonal specials, and marketing messages
Message and data rates may apply. Message frequency varies. Consent to receive marketing texts is not a condition of purchasing any service. You may opt out at any time by replying STOP to any text message. For help, reply HELP or contact us at 305-874-0260. Wiz Cleaners will not share your phone number with third parties for their own marketing purposes.
22. INDEMNIFICATION
To the fullest extent permitted by law, Customer agrees to defend, indemnify, and hold harmless Wiz Cleaners LLC, its officers, employees, agents, affiliates, shareholders, licensors, suppliers, and contractors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) Customer’s misrepresentation of property conditions; (b) Customer’s failure to comply with this Agreement; (c) use of customer-provided products or equipment; (d) Customer’s negligence or willful misconduct; or (e) third-party claims arising from services performed at Customer’s direction.
23. FORCE MAJEURE
Wiz Cleaners shall not be liable for any delay or failure to perform services resulting from circumstances beyond its reasonable control, including, but not limited to, severe weather, natural disasters, pandemics or widespread public health emergencies, government orders or restrictions, civil disturbances, labor disputes, supply chain disruptions, or equipment failures.
Force majeure events apply only to circumstances that materially impact operations on a broad scale and are outside the control of both parties. Individual circumstances affecting a Customer, including personal illness, scheduling conflicts, or access issues, do not constitute force majeure events and remain subject to the standard cancellation and rescheduling policy.
In such events, Wiz Cleaners will make reasonable efforts to reschedule the affected service. No cancellation fees will be charged for service interruptions caused solely by a qualifying force majeure event. Wiz Cleaners reserves the right to adjust scheduling as necessary under such circumstances.
24. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Wiz Cleaners LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, loss of business, or loss of use.
Wiz Cleaners LLC’s total liability for any claim arising out of or related to the services or use of the website shall be strictly limited to the amount paid by the customer for the specific service that gave rise to the claim.
PART B: WEBSITE TERMS OF USE
25. PRIVACY POLICY AND DATA COLLECTION
Your use of www.wizcleaners.com is subject to Wiz Cleaners’ Privacy Policy, found in the footer of our website, which governs the Site and informs users of our data collection practices. You acknowledge and agree that Internet transmissions are never completely private or secure, and any message or information you send to this Site may be read or intercepted by others, even if a particular transmission is encrypted.
26. COOKIES AND TRACKING TECHNOLOGIES
Wiz Cleaners and its third-party service providers use cookies, web beacons, pixels, and similar tracking technologies on www.wizcleaners.com to:

Wiz Cleaners is not responsible for the performance, security, or data practices of third-party service providers, including payment processors, CRM platforms, or advertising services.
Certain services available via www.wizcleaners.com are delivered by third-party sites and organizations. By using any product, service, or functionality originating from the www.wizcleaners.com domain, you acknowledge and consent that Wiz Cleaners may share information and data with any third party with whom Wiz Cleaners has a contractual relationship to provide the requested product, service, or functionality on behalf of www.wizcleaners.com users.
28. BOOKING AVAILABILITY DISCLAIMER
Appointment times and availability displayed on the Site are shown for convenience and are not guaranteed reservations. A booking is not confirmed until you receive a written or electronic confirmation from Wiz Cleaners. Wiz Cleaners reserves the right to cancel, modify, or reschedule any booking that cannot be fulfilled due to availability, staffing, or other operational constraints, with reasonable notice provided to the Customer.
29. LAWFUL USE OF THE SITE
You are granted a non-exclusive, non-transferable, revocable license to access and use www.wizcleaners.com strictly in accordance with this Agreement. You warrant to Wiz Cleaners that you will not use the Site for any unlawful or prohibited purpose, and will not use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Site. We reserve the right to bar any such activity.
30. TRADEMARK NOTICE AND RIGHTS
“Wiz Cleaners,” “Wiz Cleaners LLC,” the Wiz Cleaners logo, and all associated brand elements, slogans, service names, and trade dress are trademarks or registered trademarks of Wiz Cleaners LLC (collectively, the “Wiz Cleaners Marks”). All rights in the Wiz Cleaners Marks are expressly reserved.
Without the prior written authorization of Wiz Cleaners, you may not:
– Use any Wiz Cleaners Mark, or any mark confusingly similar, in any business name, domain name, social media handle, username, or URL
– Use any Wiz Cleaners Mark in any advertising, including paid search ads (e.g., Google Ads, Meta Ads), in a manner that implies affiliation, sponsorship, or endorsement
– Use any Wiz Cleaners Mark on any product, service, signage, flyer, or promotional material
– Register or attempt to register any trademark, service mark, or domain name that incorporates any Wiz Cleaners Mark or is confusingly similar
– Create any website, social media profile, or online presence that mimics, impersonates, or could be confused with Wiz Cleaners
Any unauthorized use of the Wiz Cleaners Marks is a violation of our trademark rights and may constitute unfair competition, false designation of origin, or trademark infringement under applicable federal and state law. Wiz Cleaners will vigorously enforce its trademark rights to the fullest extent of the law, including seeking injunctive relief, damages, and attorneys’ fees.

PART C: DISPUTE RESOLUTION AND GENERAL PROVISIONS
43. DISPUTE RESOLUTION AND MANDATORY ARBITRATION
In the event of any dispute, claim, or controversy arising out of or relating to this Agreement or the services or Site (a “Dispute”), the parties agree to first attempt informal resolution by contacting Wiz Cleaners at [email protected]. If the Dispute is not resolved within 30 days of written notice, either party may initiate binding arbitration.
Any Dispute not resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified herein. The arbitration shall be conducted in Miami-Dade County, Florida. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The prevailing party shall be entitled to recover reasonable attorneys’ fees and costs.
Exception: Any claim or action for indemnification, contribution, interpleader, or injunctive relief, including claims arising from trademark or copyright infringement, shall not be subject to arbitration and may be brought in a court of competent jurisdiction.
Arbitration Opt-Out
You have the right to opt out of this mandatory arbitration provision. To do so, you must send a written notice of your decision to opt out to [email protected] within 30 days of first booking or first using the Site. Your opt-out notice must include your full name, address, phone number, and a clear statement that you wish to opt out. If you opt out, disputes will be resolved in the courts specified in Section 45.
44. CLASS ACTION WAIVER
ANY ARBITRATION UNDER THESE TERMS WILL TAKE PLACE ON AN INDIVIDUAL BASIS ONLY. CLASS ARBITRATION AND CLASS, COLLECTIVE, CONSOLIDATED, AND/OR REPRESENTATIVE ACTIONS ARE NOT PERMITTED. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH PARTY’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE, AND/OR REPRESENTATIVE PROCEEDING, INCLUDING IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION. UNLESS BOTH PARTIES AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS.
45. GOVERNING LAW AND VENUE
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. To the extent any court action is permitted under this Agreement, all disputes shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you hereby consent to the personal jurisdiction of such courts. The prevailing party in any such action shall be entitled to recover reasonable attorneys’ fees and costs.
46. ELECTRONIC AGREEMENT AND BINDING ACCEPTANCE
By booking, scheduling, or receiving services, or by accessing or using the Site, you acknowledge that you have read and agree to be bound by this Agreement. Your electronic acceptance, digital interaction, verbal confirmation, or continued use constitutes a valid, binding agreement with the same legal effect as a handwritten signature. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings to the same extent as other business documents originally maintained in printed form.
47. PRIVACY AND DATA SHARING

48. SEVERABILITY AND WAIVER
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect. Our failure to insist upon or enforce strict performance of any provision shall not be construed as a waiver. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement.
49. ASSIGNMENT
Wiz Cleaners may assign its rights and duties under this Agreement to any party at any time without notice to you. You may not assign your rights or obligations under this Agreement without the prior written consent of Wiz Cleaners.
50. CHANGES TO TERMS
Wiz Cleaners reserves the right to update or modify these Terms at any time, with or without prior notice. The updated Terms will be posted at www.wizcleaners.com and will be effective upon posting. Your continued use of our services or Site after any modification constitutes your acceptance. It is your responsibility to review these Terms periodically.
51. ENTIRE AGREEMENT
This Agreement, together with our Privacy Policy and any booking confirmation, constitutes the entire agreement between you and Wiz Cleaners with respect to the subject matter hereof, and supersedes all prior or contemporaneous understandings, representations, warranties, and agreements, whether written, oral, or electronic, relating to such subject matter. No modification of these Terms will be effective unless authorized in writing by Wiz Cleaners. It is the express wish of the parties that this Agreement and all related documents be written in English. In the event of any conflict, inconsistency, or difference between this document, the Privacy Policy, any service summaries, estimates, or customer-facing materials, the full Terms of Service available at www.wizcleaners.com shall control and govern.
ACKNOWLEDGMENT OF AGREEMENT
I HEREBY ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THESE TERMS OF SERVICE AND PRIVACY POLICY AND AGREE THAT MY USE OF THE WIZ CLEANERS PLATFORM IS AN ACKNOWLEDGMENT OF MY AGREEMENT TO BE BOUND BY ALL OF THE TERMS OF SERVICE, AND THAT THIS AGREEMENT CONSTITUTES A VALID AND BINDING AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF SERVICE, YOU MUST NOT USE THE WIZ CLEANERS PLATFORM OR SERVICES.
